RWIS - Terms and Conditions of use

The App RWIS by Boschung (referred hereinafter as «Boschung App» or «App») has been designed and developed and is operated by Boschung (referred hereinafter as "Provider"). By using this App, you are agreeing to be bound by these App Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using this App. Boschung App may modify these terms at any time. The modified Terms and Conditions of Use shall be effective upon posting. Any use after modification, login to the App included, constitutes acceptance of the new modified Terms and Conditions of Use and that you are legally bound by them.

App information and Services are provided for personal, non-commercial use only. Permission is granted to temporarily download one copy of the materials (information or software) on Boschung App for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials;
• Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
• Attempt to decompile or reverse engineer any software contained on Boschung App;
• Remove any copyright or other proprietary notations from the materials; or
• Transfer the materials to another person or "mirror" the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Boschung at any time.

Each user is personally and solely responsible for all actions and transactions made through his/her account. You are responsible for maintaining the confidentiality of your password and you should ensure that you exit properly from your account at the end of each session. In case you notice any unauthorized use of your account or any other (real or potential) breach of security, you have to immediately notify the Boschung App administrators. Boschung App is under no circumstances liable for any loss or damages arising from your failure to comply with this term. Boschung App maintains the right to delete an account, if violation of any of these Terms is proved.

Boschung App keeps a File of Personal Data (username and password) of its registered users, according to Law. The purpose of this data collection is their storage on a server, for your identification by the server and your access to the pages and services of Boschung App. By accepting these Terms and Conditions of Use you also allow Boschung App to process your Personal Data. The location function used in our Boschung App is only used to provide you with easy access to your current location on the map.

Boschung App as a work of Intellectual Property is protected by European Law for Intellectual Property, as modified and in force today and by the international treaties and conventions. Boschung App and his partners maintain the exclusive Intellectual Property Rights upon design, source code and the whole content of the App. Violation by any means of these rights will draw the subsequent penalties and liability defined by the applicable law. Indicatively, and non-exclusively, copying, modifying, publishing, distributing by any means of the App's content without prior written permit of the Provider is prohibited. Furthermore copying, modifying, decompiling or by any means unauthorized use of the App's software is prohibited. «RWIS by Boschung» trademark and all trademarks appearing on the App are property of the Provider and are protected by trademark laws, as well as by international treaties and conventions. Use of these trademarks is by all means prohibited.

Provided that you comply with the present Terms and Conditions of Use, Boschung App grants you an exclusive, non-transferable right to access the App and its services for the purposes mentioned in the Terms and Conditions of Use. Other uses of Boschung App that oppose to the present Terms and Conditions of Use are strictly forbidden.

The materials (information or software) on Boschung App are provided "as is". Boschung App makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Boschung App does not guarantee the correctness, validity or scientific accuracy of the information contained on the App, provided in any possible form, such as images, video, text, graphics etc. The information provided should under no circumstances be regarded as advise, suggestion or incitement for a certain act. Any actions undertaken by users based on the information provided on the App do not create any liability of the Provider. The information collected and published may contain errors, due to the intrinsic limitations of radio communications (e.g. limited coverage, interference, attenuation, special weather conditions etc.), due to other factors beyond the control of the Provider. Data is provided for informational reasons only. Consequently, the Provider, the administrators of Boschung App cannot provide any type of guarantee neither are responsible for the correctness, validity, thoroughness and accuracy of that information published, nor for the suitability of their usage for purposes other than informational only. Due to the nature and to the extent of information provided through the Internet, under any circumstances, negligence included, the Provider will not be held liable for any kind of damages you may suffer from the use of the Boschung App, choices and content of Boschung App. You use Boschung App and the above content and services at your own initiative and risk.

You agree that you will not use or attempt to use any method, device, software or routine to harm others or interfere with functioning of the App or use and/or monitor any information in or related to the App for any unauthorized purpose. Specifically, each Participant, whether authorized or unauthorized, agrees that it will not (and will not permit any of its employees, agents, and any other third party) do any of the following:

• Use this App or the Data or provide, link, or otherwise make available, any information on the App that is unlawful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, harmful to minors or racially, ethnically or otherwise objectionable;
• Impersonate any person or entity, or otherwise misrepresent your affiliation;
• Manipulate, forge, or otherwise modify information or identifiers in a manner, which may hide or disguise the origin of any information;
• Modify, reverse engineer, reverse assemble, decompile or hack into any of the software applications or related tools or utilities used by this App;

The contents, services and software of Boschung App are provided on an 'as is' and 'as available' basis with no explicit, or presumed in any way, guarantees concerning the App’s marketability, non infringement or suitability for a particular purpose. In no event shall Boschung App be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Boschung App, even if Boschung App authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Boschung App offers no guarantee that the pages, services, functions, choices and content of the Appe will be provided without interruption or without errors or that mistakes will be corrected. In no case will the Provider, the persons associated to him or the administrators of Boschung App be liable to you or any other person or entity for any indirect, incidental, special, punitive or consequential damages or loss of profit or revenue caused by the use of the App. The materials appearing on Boschung App could include technical, typographical, or photographic errors. Boschung App does not warrant that any of the materials on its App are accurate, complete, or current. Boschung App may make changes to the materials contained on its App at any time without notice.

Any claim relating to Boschung App shall be governed by the laws of the country of Switzerland without regard to its conflict of law provisions. If you disagree with the present Terms of Use you should not use the Boschung App.
